DMV license suspension for DUI

The Department of Motor Vehicles (DMV) can suspend your driver’s license based upon the accusation of driving under the influence. Even if you were only given a citation by the Officer, the DMV can suspend your privilege to drive without a court trial. You are entitled to a hearing with the DMV to present your case

Administrative Per Se Hearing

The hearing officer will consider 3 factors during the hearing for driving under the influence of alcohol: 1) Was there reason to believe the individual was driving under the influence; 2) Was the driver lawful arrested; and 3) was the driver driving with .08% or greater blood alcohol content at the time of driving.

DMV Process
